SUBJECT: Implementation of Final Rule FR 5356-F-02, “Federal Housing Administration:
Continuation of FHA Reform—Strengthening Risk Management through
Responsible
FHA-Approved Lenders”

"This Mortgagee Letter provides an overview of key provisions of HUD’s recently issued
final rule referenced above, and guidance to mortgagees on HUD’s implementation of this
final rule. This rule increased the net worth requirements for FHA-approved mortgagees,
eliminated FHA approval of loan  correspondents, codified requirements of the Helping
Families Save Their Homes Act of 2009 (Public Law 111-22), and made minor modifications
to other aspects of FHA’s regulations governing lender activities. Changes to applicable
HUD Handbooks are forthcoming…"

Fannie Mae, Freddie Mac to Deploy Appraisal
Complaint
Process

Washington, DC – Fannie Mae and Freddie Mac will deploy a complaint
process for
violations of the Home Valuation Code of Conduct (HVCC), according
to a letter from FHFA
Acting Director Edward J. DeMarco to New York Attorney General
Andrew Cuomo. The letter,
which outlines developments with the HVCC and related
agreements, states that Fannie Mae
and Freddie Mac, now in conservatorship, will not
be funding the Independent Valuation
Protection Institute (IVPI).

This Mortgagee Letter provides clarification and reaffirms Federal Housing
Administration (FHA) appraisal requirements related to appraiser independence
and announces new requirements pertaining to entities that are eligible to order
appraisals for FHA insured mortgages.

MORTGAGEE LETTER 2009-29 
SUBJECT:    Appraisal Portability
 
This mortgagee letter addresses the portability of appraisals for the purpose of
facilitating the loan process when a borrower switches from one Federal Housing
Administration (FHA) approved lender (first lender) to another (second lender)
and an appraisal was ordered by and completed for the first lender.   This mortgagee
letter will be effective for all case numbers assigned on or after January 1, 2010.
